By accessing or using the Bite Logic application ("App") provided by APEX ADVANTAGE LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms apply to all users of the App, including beta testers, registered users, and visitors.
Bite Logic is a fishing intelligence application that provides bite condition scoring, lure recommendations, solunar timing, weather data, and catch logging features. The App is designed for recreational fishing use only.
During the beta period, access to the App is limited to invited testers who have received a valid access code from the Company.
Access to the App during the beta period requires a valid invite code issued directly by the Company. Invite codes are personal and non-transferable.
The App is provided in beta form and may contain errors, bugs, incomplete features, or inaccuracies. The Company makes no warranty that the App will function without interruption or error.
Beta testers are encouraged to submit feedback via feedback@bitelogicapp.com. By submitting feedback, you grant the Company a perpetual, royalty-free license to use that feedback for product development purposes.
You agree to use the App only for lawful purposes. You may not:
The Bite Logic scoring engine and lure recommendations are provided for informational and entertainment purposes only. The Company makes no warranty that:
You assume all responsibility for your own fishing decisions, including compliance with all applicable fishing regulations, licensing requirements, season dates, and catch limits. Always verify current regulations with your state or provincial fish and wildlife agency before fishing.
All content, features, and functionality of the App — including the scoring engine architecture, domain methodology, lure recommendation logic, algorithms, software, text, graphics, and data — are owned exclusively by APEX ADVANTAGE LLC and are protected by applicable intellectual property laws.
You retain ownership of catch data you submit through the App. By submitting catch data, you grant the Company a non-exclusive, royalty-free, perpetual license to use that data in aggregate and anonymized form for the purpose of improving the App's scoring engine.
Photos submitted through the App have GPS metadata automatically stripped before storage. You retain ownership of submitted photos and may request deletion at any time by contacting us.
By submitting community alerts through the App, you grant the Company a license to display that content to other users. You represent that your submissions are accurate and do not violate the rights of any third party.
The App integrates with third-party weather and mapping data providers. The Company is not responsible for the accuracy, availability, or reliability of third-party data.
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company does not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by applicable law, APEX ADVANTAGE LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or personal injury, arising out of or related to your use of the App, even if the Company has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless APEX ADVANTAGE LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the App or your violation of these Terms.
The Company reserves the right to modify these Terms at any time. We will notify users of material changes via the App or by email. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
The Company may suspend or terminate your access to the App at any time, with or without cause, with or without notice.
These Terms are governed by the laws of the State of Alabama. Any disputes arising under these Terms shall be resolved in the courts of Madison County, Alabama.
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the App.
